1. Agreement and eligibility

By applying for, accessing or using a seller account, the seller agrees to these Terms. A seller must be at least 18 years old, provide accurate information, have authority to sell each listed item, maintain a valid PayPal account, and comply with applicable Australian laws.

2. Account approval and verification

Registration does not guarantee approval. Used Bus Parts may request identity, business, ABN, ownership or payment verification before approving or continuing an account. Sellers must promptly keep their account information accurate and secure.

3. Listings and item condition

Listings must accurately describe the actual item offered, use genuine photographs where reasonably possible, disclose known faults, damage, missing components and material limitations, and must not be misleading or deceptive. Sellers must not list stolen, counterfeit, unlawful, unsafe or intellectual-property-infringing goods.

4. Pricing, availability and orders

Sellers are responsible for prices, quantities, availability, freight information and fulfilment. Sellers must honour completed transactions unless cancellation is reasonably required because of an obvious error, illegality, fraud concern or stock discrepancy.

5. Payment terms and marketplace commission

Third-party seller transactions are processed by PayPal only. Used Bus Parts charges the marketplace fees shown in the current Fee Schedule, including a standard commission of 7.5% of the item sale price, excluding freight unless otherwise stated. The seller authorises deduction of the commission and any agreed adjustments, refunds, reversals, chargebacks or payment-provider fees before the seller balance is released or reconciled.

Payment to a seller may be delayed while buyer payment clears, a freight amount is confirmed, fraud or identity checks are completed, or a dispute, refund, chargeback or legal requirement remains unresolved. PayPal onboarding and marketplace payment functionality may be subject to PayPal approval and separate PayPal terms.

5A. Seller cancellation fees

If a seller cancels an order after buyer payment has been received, a cancellation fee of 3% of the transaction total, with a minimum of $0.30, may be charged to recover payment-processing and administration costs. The fee will not be applied where the cancellation results from a platform error, duplicate payment, suspected fraud, a lawful consumer remedy, or another circumstance where charging it would be unlawful or unreasonable.

6. Freight, pickup and fulfilment

Sellers must package goods appropriately, provide accurate dimensions and weight when requested, dispatch within the stated period, communicate delays, and provide tracking where available. Risk, title and responsibility for freight are governed by the listing, agreed delivery arrangement and applicable law.

7. Returns, refunds and consumer law

Sellers must comply with the Australian Consumer Law and any other non-excludable legal obligations. A listing condition or “as-is” statement does not remove rights that cannot legally be excluded. Sellers must cooperate with legitimate refund, return, chargeback and dispute processes.

8. Seller conduct

Sellers must communicate professionally, protect buyer information, avoid abusive or discriminatory conduct, not manipulate ratings or transactions, and not use the Marketplace to divert transactions for the purpose of avoiding fees.

9. Fraud, suspicious activity and account protection

Where Used Bus Parts reasonably believes that an account, listing, transaction or connected activity may be fraudulent, deceptive, unauthorised, unlawful, compromised, or otherwise presents an unacceptable risk, Used Bus Parts may act without prior notice. Actions may include temporarily suspending or permanently terminating the account, hiding listings, restricting access, cancelling or declining transactions, holding or delaying funds where legally permitted, requesting additional verification, preserving records, and reporting suspected unlawful conduct to payment providers, regulators or law-enforcement authorities.

Protective action does not necessarily amount to a final finding that fraud occurred. Where practical and appropriate, the seller will be advised of the reason and any steps available for review.

10. Suspension and termination

Used Bus Parts may suspend, reject, close or terminate an account for breach of these Terms, false information, repeated failure to fulfil orders, unresolved complaints, payment risk, security concerns, unlawful conduct, reputational risk, inactivity, or conduct that threatens the proper operation of the Marketplace. Existing obligations and transaction records survive account closure where necessary.

11. Ratings and reviews

Ratings may be limited to verified transactions. Used Bus Parts may remove reviews that are fraudulent, abusive, irrelevant, unlawful or otherwise breach marketplace policy. Sellers must not offer improper incentives or create false activity to influence ratings.

12. Privacy and records

Seller information, acceptance details and activity records may be collected and retained to operate the Marketplace, prevent fraud, administer payments, resolve disputes and comply with law. Sellers must only use buyer information for fulfilling the relevant transaction and lawful related purposes.

13. Marketplace role and liability

Unless expressly identified as the seller, Used Bus Parts provides a marketplace platform and is not the manufacturer or supplier of third-party listed goods. To the maximum extent permitted by law, Used Bus Parts is not responsible for indirect or consequential loss, seller representations, item suitability, freight-carrier conduct or disputes between users. Used Bus Parts does not inspect or guarantee third-party listings and is not responsible for a seller's description, title, condition, ownership, legality, supply or delivery of goods, except to the extent liability cannot lawfully be excluded. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded.

14. Changes to these Terms

These Terms may be updated with reasonable notice. Continued use after revised terms take effect may require fresh acceptance. The recorded terms version and acceptance details form part of the seller’s account record.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the courts and tribunals having jurisdiction there, subject to any mandatory law.
